Affiliate agrees to obtain permission in writing from Money Secrets Online for any banners other than those supplied as part of the Affiliate Program. Such approval shall not be unduly withheld. Any text links other than those supplied shall not misrepresent Money Secrets Online.
Affiliate is solely responsible for ensuring that the correct URL is used in advertising and promotions.
Promoting the Money Secrets Affiliate Program via unsolicited email is strictly prohibited, and Affiliate agrees to not reference the Money Secrets Online or any subsidiary web site in any e-mail or communication which is unsolicited or where there is no prior business relationship with the recipient.
Affiliate may not link to MoneySecretsOnline.com or any subsidiary web site from a site which promotes spam, spam software, illegal activities, sexual matter, or discrimination. The following sites are specifically not allowed to participate in the Money Secrets Online Affiliate Program: Adult sites or sites that display adult banners, sites that promote violence, bigotry or hatred, sites that promote illegal activities.
Affiliate may not link to the UltimateMerchant.com or any subsidiary web site from any site promoted by unsolicited email or inappropriate newsgroup postings.
Affiliate understands that Money Secrets Online and Wealth Dynamics International Pty Ltd will terminate this agreement and withhold all referral fees due if Affiliate is found in violation of this policy.
Additionally, Affiliate agrees to pay $1000 minimum for any
downtime, as well as ISP fees and legal fees, if they cause
MoneySecretsonline.com or any subsidiary web site to lose Internet
access or connectivity because of inappropriate, unethical,
or illegal online activities like spamming.
Affiliate agrees to indemnify and hold harmless UltimateMerchant.com, and their officers and employees from any legal actions brought against same caused by actions of the Affiliate.
All sales originating from Affiliate's referral URL or Affiliate's sub-associate, and processed by Money Secrets Online earn referral fees as outlined below. Money Secrets Online and Wealth Dynamics International Pty Ltd reserve the right to reject any order that does not comply with our order policy.
Affiliate agrees to accurately represent the product and make no claims regarding the benefits to the customer other than those which appear on the Web site which is created as part of the Money Secrets Online Affiliate Program.
Referral Fees
Purchase of the Money Secrets Online Service by Affiliate's customers will earn Affiliate a referral fee of 50% of the retail price on each sale. This percentage may be changed by Money Secrets Online as it sees fit.
Wealth Dynamics International Pty Ltd and Money Secrets Online are not responsible for any defects in the Affiliate Tracking Software. Referrals are earned on each calander month's sales by the Affiliate starting on the 1st through the last day of the month.
Wealth Dynamics International Pty Ltd will pay Affiliate referral fee payments in U.S. dollars via Clickbank every 14 days.
If the purchase of the Money Secrets Online is cancelled by the Affiliate's customer, if there is a chargeback, a refund or a non-payment the appropriate referral fee(s) will be deducted from Affiliate's next monthly check.
Additional Terms
Every customer who purchases Money Secrets Online or related products is a customer of Money Secrets Online and Wealth Dynamics International Pty Ltd. Affiliate does not have authority to make any offer or accept any payment on behalf of Money Secrets Online or Dyanmic Wealth International. We are not responsible for representations or actions of Affiliates.
Wealth Dynamics International Pty Ltd and Money Secrets Online will make every effort to ensure that the Money Secrets Online Web Site is operational.
However, the Internet is inherently an unreliable medium, and Affiliate agrees to hold us harmless for any service interruptions by Wealth Dynamics International Pty Ltd, Money Secrets Online or related sub-contractors of Money Secrets Online and Wealth Dynamics International Pty Ltd
Affiliate is an independent contractor, and agrees they are working independently and are responsible for calculating and paying their own taxes on all income generated as a result of the Money Secrets Online Affiliate Program.
Nothing in this Agreement shall create any form of partnership, joint venture, employment relationship or other legal relationship except as set forth in this Agreement between the parties.
Termination and Changes
Money Secrets Online and Wealth Dynamics International Pty Ltd and/or the Affiliate have the right to immediately terminate this agreement at any time and for any reason by notifying the other party in writing or via e-mail. The final referral fee payment to Affiliate may be withheld for a reasonable time in order to ensure an accurate calculation of referral fees.
This agreement shall remain in effect for as long as Wealth Dynamics International Pty Ltd and Money Secrets Online make the Money Secrets Online Affiliate Program available, unless the agreement is terminated due to breach of terms.
Money Secrets Online and Wealth Dynamics International Pty Ltd reserve the right to change any of these terms and conditions at any time by posting a new Agreement on the Money Secrets Online Web site.
Governing Law: This agreement shall be governed by the laws of New South Wales, Australia.
